Frequently Asked Questions

In the U.S., renewing a trademark costs $325 per class for a Section 9 renewal or a Section 8 Declaration of Use, while filing both together is $650 per class.

A trademark registration is valid for 10 years from the registration date. To maintain it, the owner must file a Section 8 Declaration of Use between the 5th and 6th year and renew it with a Section 9 Renewal every 10 years.

You must file a Section 8 Declaration of Use between the 5th and 6th year after registration to confirm it is still in use, with a 6-month grace period available for late filings. Additionally, a Section 9 Renewal (or combined Section 8 & 9 filing) is required at the 10-year mark and every 10 years thereafter to maintain registration, also allowing a 6-month grace period for late renewal.

If you fail to renew your U.S. trademark registration, it will expire and be canceled. After expiration, your exclusive rights to the mark are lost, and others may legally use or register the same or similar mark. The only recourse is to file a new application.

Trademarks must renewed every 10 years after registration. Additionally, a Section 8 Declaration of Use must be filed between the 5th and 6th year to confirm the mark is still in use.
