You can file your trademark application online through the USPTO’s Trademark Electronic Application System (TEAS). Once submitted, a USPTO attorney reviews your application to ensure it meets all requirements. If approved, your mark is published in the Official Gazette, which opens a 30-day window for others to raise any objections. If no opposition is filed—or if any challenge is resolved in your favor—you’ll receive a Certificate of Registration, officially granting you the rights to use your mark in commerce.

On average, the trademark registration process takes about 8–12 months. However, if complications arise—such as oppositions or other delays—it can stretch to 18 months or longer. If a USPTO attorney issues an office action because of conflicts or technical issues, preparing and submitting your response may add another 3–6 months to the timeline.

The base application fee with the USPTO is $350, although this can go up with surcharges that may be imposed due to

1. Insufficient Information- $100 per class
2.  Custom Description- $200 per class
3. Lengthy Description (over 1,000 words)- $200 per class

After you file a trademark,

• The USPTO examines your trademark application. You may receive an Office Action if issues need correction.
• The mark is published for a 30-day opposition period.
• If unopposed, it is registered (or a Statement of Use is filed for intent-to-use applications).
